This consent form outlines the terms and conditions of the trainings to be provided by LAD Irrigation Company, Inc. (“LAD”). Please read the following statements carefully and let us know if you have any questions before signing.
Consent to Training
I hereby agree and consent to the provision of irrigation systems related trainings to me by LAD. I understand that LAD will explain the nature and purposes of the recommended procedures, and will inform me of expected benefits and risks that may arise. By signing this consent form, I acknowledge that I understand and consent to receiving irrigation equipment and systems related training services from LAD, including the following:
1. Nature of Trainings:
I understand that trainings will relate to the operation and use of irrigation related equipment which includes potentially live electronic systems and may involve direct contact with operational electrical systems, which may include physical contact. As a result, I may be exposed to systems that could cause injury or death if not handles appropriately. The injuries and complications from contacting live electrical systems range in severity from minor to catastrophic requiring hospitalization, and include, but are not limited to, burns, shock, and death. I understand that LAD makes no guarantees that I will not be exposed to or contact live electrical systems and further, makes no assurances relating to the risk or outcome of such exposure. I understand that notwithstanding the safety practices, measures, and policies employed or adopted by LAD, there will still be risks associated with such trainings and applying such trainings, as outlined above. I also understand that these trainings require good physical condition and a degree of skill and knowledge. I believe I possess the good physical conditioning and the degree of skill and knowledge necessary to participate in these trainings safely.
2. Assumption of Risk:
I understands that by participating in trainings with LAD, I may be exposed to potentially hazardous conditions, including but not limed to, the risk of contact with electrical systems, serious injury, and death. I fully understand and appreciate the risks inherent to the trainings, and hereby expressly assume the risk of any bodily injury, illness, death, medical treatment, property damage, or other harm that may result from these trainings or after and as a result of these trainings.
3. Waiver of Liability:
I hereby release, discharge, and agree to indemnify and hold LAD harmless from, and waive on behalf of myself, my company, and my family, heirs, and personal representatives, any and all present and future claims, causes of action, suits, demands, costs, expenses, and compensation for any damage or loss to myself and/or property that may be caused any act, or failure to act on the part of LAD, or that may otherwise arise out of or be connected to my activities at the trainings or because of the trainings with LAD. U understand that this release discharges LAD from any and all liabilities or claims that I, my company, or my family, heirs, and personal representatives may have against LAD with respect to any bodily injury, wrongful death, or property damage that may arise from or be related to the trainings. This liability waiver and release extends to LAD together with all of its officers, directors, employees, agents, affiliates, and assignees.
4. Electronic Trainings:
I understand that trainings may involve interactive video, audio, or data communication. I also understand that while it can be an effective means of delivering trainings, there may be limitations, such as technical issues, interruptions, or equipment failure.
5. Technical Requirements:
I understand that I must have access to the necessary technology (such as a smartphone, computer, or tablet with video and audio capabilities) and a reliable internet connection to participate in certain training sessions. I agree to ensure that these technical requirements are met for each session.
6. Governing Law:
Any dispute arising out of this Release shall be governed by the laws of the State of Washington. Venue shall lie exclusively within Benton County, Washington
7. Severability:
If any provision of this Release is held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not affect the remainder of this Release.
Acknowledgment and Consent:
By signing below, I acknowledge that I have carefully read and clearly understood the information provided in this form. I consent to receiving training from LAD Irrigation Company, Inc., and I understand the risks and benefits involved and voluntarily sign below.
